YubaEats Terms of Service

Welcome to YubaEats. YubaEats is operated by FITCHCRAFT (“YubaEats,” “we,” “us,” or “our”).

By creating an account, accessing, or using YubaEats, you agree to these Terms of Service and our Privacy Policy.

If you operate a food truck on YubaEats, the Food Truck Partner Agreement also applies to your business.

1. What YubaEats Does

YubaEats helps people discover and connect with local food trucks and other participating food vendors. Food trucks and vendors listed on YubaEats are independent businesses. They are not employees, agents, partners, or representatives of YubaEats. YubaEats does not prepare, sell, inspect, or guarantee food offered by participating vendors.

2. Accounts

You are responsible for:

• Providing accurate account information.
• Keeping your login credentials secure.
• Activities performed through your account.
• Promptly updating information that becomes inaccurate.

You may not impersonate another person or business or create an account for fraudulent, abusive, or unlawful purposes.

3. Food Truck and Vendor Listings

Food truck and vendor listings may include information such as:

• Business name
• Menu or food offerings
• Photos
• Pricing
• Hours
• Locations
• Events
• Contact information

Participating vendors are responsible for keeping their information accurate. Truck locations, operating hours, menus, prices, and availability may change. YubaEats does not guarantee that a vendor will be present, open, stocked, or available at a particular time or location. Vendor participation and public listing may require YubaEats approval.

4. Membership, Purchases, and Payments

The current standard YubaEats food-truck membership price is $39 per month. YubaEats charges participating food trucks 0% commission on their food sales. Food trucks keep 100% of their direct customer sales, subject to their own taxes, payment-processing fees, refunds, chargebacks, and ordinary business expenses. Submitting a truck application by itself does not create a membership charge. Before any recurring membership charge begins, YubaEats will provide the applicable billing details and obtain any authorization required by law.

Unless YubaEats specifically states otherwise, purchases from a food truck or vendor are transactions directly between the customer and that independent business. YubaEats does not currently provide general payment processing through the platform. Any future payment-processing services, optional paid services, transaction fees, or other charges will be disclosed before they apply.

5. Reviews and User Content

Users may be able to submit reviews, comments, photos, or other content.

You may not submit content that:

• Is knowingly false or misleading.
• Harasses or threatens another person.
• Violates another person's rights.
• Contains unlawful material.
• Is spam or commercial abuse.
• Impersonates another person or business.

You retain ownership of content you create. By submitting content to YubaEats, you give YubaEats a non-exclusive, worldwide, royalty-free license to display, reproduce, and use that content as reasonably necessary to operate and promote the YubaEats service. YubaEats may remove or moderate content at its discretion.

6. Acceptable Use

You may not:

• Attempt to gain unauthorized access to another account or YubaEats systems.
• Interfere with the operation or security of the service.
• Scrape or harvest information in a manner that violates law or these Terms.
• Use YubaEats for fraudulent or unlawful activity.
• Misrepresent your relationship with YubaEats.
• Abuse reviews, ratings, reporting, or other platform features.

7. Suspension and Removal

YubaEats may suspend or remove an account, listing, review, or other content when reasonably necessary to:

• Protect users or businesses.
• Address suspected fraud or abuse.
• Enforce these Terms.
• Respond to legal requirements.
• Protect the safety or integrity of the platform.

8. Third-Party Businesses and Services

Food trucks and other businesses appearing on YubaEats are responsible for their own products, food safety, licenses, permits, employees, taxes, insurance, pricing, customer service, and legal compliance. YubaEats is not responsible for the acts or omissions of independent vendors. The platform may also rely on third-party technology providers for services such as hosting, authentication, email, databases, or analytics.

9. No Guarantee of Availability

We work to keep YubaEats available and accurate, but the service is provided on an “as available” basis. We do not guarantee uninterrupted service, error-free operation, or continuous availability of any particular vendor, feature, or listing.

10. Limitation of Liability

To the fullest extent permitted by law, YubaEats and FITCHCRAFT will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service or dealings with an independent food truck or vendor. Nothing in these Terms limits liability where applicable law does not permit such a limitation.

11. Changes to YubaEats or These Terms

YubaEats may add, remove, or modify features over time. We may also update these Terms. Material changes will be posted through the service or otherwise communicated when appropriate. The “Last Updated” date above will show when these Terms were most recently revised.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal proceeding relating to these Terms will take place in the appropriate state or federal court located in Yuba County, California, unless applicable law requires otherwise.
